Terms of Service
These terms govern access to and use of the LeadIntersect website. Client services are governed by a separate written agreement.
1. Acceptance of these terms
These Terms of Service form an agreement between you and Nedvidek Group Inc., operating as LeadIntersect ("LeadIntersect," "we," "us," or "our"). By accessing or using this website, you agree to these terms and our Privacy Policy. If you do not agree, do not use the website.
You represent that you have the legal capacity to agree to these terms. If you use the website on behalf of an organization, you represent that you have authority to act for that organization.
2. Website purpose
The website provides general information about LeadIntersect and its recruiting growth services for real estate brokerages. Website content is informational and does not constitute legal, financial, employment, real estate, or other professional advice.
Submitting an inquiry, booking a call, or communicating with us does not by itself create a client relationship, partnership, agency relationship, fiduciary relationship, or obligation to provide services.
3. Client services and separate agreements
Any paid work, scope, fees, advertising budget, deliverables, approvals, data access, confidentiality obligations, intellectual property rights, and termination rights will be set out in a separate written service agreement accepted by LeadIntersect and the client.
If these website terms conflict with a signed service agreement, the signed service agreement controls for the services covered by it.
4. Results, claims, and business decisions
Recruiting and marketing outcomes depend on factors outside our control, including market conditions, brokerage economics and reputation, offer strength, advertising performance, candidate interest, client responsiveness, interview quality, and follow-up.
Unless a signed service agreement expressly states otherwise, LeadIntersect does not guarantee any number of leads, applications, interviews, appointments, signed agents, retained agents, production, revenue, profit, return on investment, or other business result.
You remain responsible for evaluating information, making hiring and recruiting decisions, verifying legal and regulatory requirements, and ensuring that claims supplied to us are accurate, supportable, and authorized for use.
5. Acceptable use
You may use the website only for lawful purposes. You must not:
- attempt to gain unauthorized access to the website, its systems, or related accounts;
- interfere with the website's security, availability, or operation;
- introduce malicious code, automated abuse, or excessive requests;
- misrepresent your identity, authority, affiliation, or intentions;
- use website content in a way that infringes another person's rights or violates applicable law; or
- copy, scrape, republish, sell, or exploit substantial portions of the website except as permitted by law or by our written consent.
6. Intellectual property
The website and its original content, branding, graphics, layout, and materials are owned by or licensed to Nedvidek Group Inc. and are protected by applicable intellectual property laws. LeadIntersect and its logos are identifiers of Nedvidek Group Inc.
We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the website for your internal informational purposes. No other rights are granted.
7. Third-party links and services
The website may link to third-party websites or services, including scheduling and social media platforms. We do not control those third parties and are not responsible for their content, security, availability, or practices. Your use of a third-party service is governed by that provider's terms and policies.
8. Privacy and communications
Our collection and handling of personal information is described in our Privacy Policy. By sending an inquiry or booking a call, you authorize us to respond using the contact details you provide. You may ask us to stop non-essential communications at any time.
9. Availability and disclaimers
We aim to keep the website useful and accurate, but it is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim warranties and conditions, whether express, implied, statutory, or otherwise, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, title, and non-infringement.
We may update, suspend, or discontinue any part of the website without notice. We do not warrant that the website will always be available, secure, complete, current, or free from errors or harmful components.
10. Limitation of liability
To the maximum extent permitted by applicable law, Nedvidek Group Inc. and its directors, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, opportunities, or business interruption arising from or related to the website.
To the maximum extent permitted by applicable law, our total aggregate liability arising from or related to the website will not exceed CAD $100. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited.
11. Changes, governing law, and general terms
We may revise these terms by posting an updated version and changing the effective date above. Your continued use of the website after an update means you accept the revised terms.
These terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles. Subject to any mandatory law, disputes relating to these terms or the website will be brought exclusively before the courts located in Ontario.
If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these terms without our written consent. These terms and the Privacy Policy are the entire agreement concerning use of the website, except where a separate signed agreement applies.
